OFFICIAL RULES

NO PURCHASE NECESSARY. OPEN AND OFFERED ONLY TO LEGAL U.S. RESIDENTS WHO ARE LEGAL AGE SMOKERS AND RESIDE IN ONE OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA THROUGHOUT THE PROGRAM PERIOD. SUBJECT TO AND GOVERNED BY THE LAWS OF THE STATE OF GEORGIA AND THE UNITED STATES. VOID WHEREVER PROHIBITED BY LAW.

PROGRAM:

The “Captain Black Passport to Discovery Program” (the “Program”) consists of Specially Marked Passport Stamps (“Stickers”) from participating Captain Black® Little Cigar packages worth points that can be used to redeem merchandise.

PROGRAM PERIOD:

The Program shall commence on February 24, 2006 and shall terminate on December 31, 2007. Continuation of the Program beyond this Period shall be at the discretion of Lane Limited (Sponsor).

WHAT IS A CODE?:

A code is a unique, six (6) or ten (10) digit alphanumeric code (“Code”). Each Code is worth 10 points and can be used towards redeeming merchandise (see Rule 4 below). Special bonus codes may be available online or via email throughout the Program Period.

1. GET A 10 POINT PASSPORT STAMP WITH CODE:

At participating retail outlets, from February 15, 2006 through December 31, 2007, or while supplies last, look for specially-marked stickers affixed to participating Captain Black Little Cigars packages. Each Sticker will contain one (1) Code worth 10 points. Not all brands or package sizes may be available with stickers in all areas throughout the Program Period. NO PURCHASE NECESSARY. To receive a Sticker with one (1) Code and/or a copy of the Official Rules without purchase, while supplies last, send a self-addressed stamped envelope postmarked by December 22, 2007 (to be received by December 31, 2007) to “Captain Black Passport to Discovery Points Request”, PO Box 43364, Atlanta, GA 30336. Limit one free Sticker per request per stamped outer envelope. No mechanically reproduced or photocopied requests accepted. Residents of VT may omit return postage. Sponsor assumes no liability for lost, late, stolen, misdirected, mutilated, illegible, incomplete or postage due mail or requests. Requests become the property of Sponsor and will not be returned.

2. REGISTER ONLINE AT www.captainblacklittlecigars.com

Go to Web Site (www.captainblacklittlecigars.com) during the Program Period and follow onscreen instructions to register. LANE LIMITED ONLY MARKETS ITS TOBACCO PRODUCTS TO LEGAL AGE SMOKERS. IN ORDER TO BE ELIGIBLE TO PARTCIPATE IN PROMOTIONS OR RECEIVE MAILINGS FROM US, YOU MUST CERTIFY THAT YOU ARE A LEGAL AGE SMOKER AND WISH TO RECEIVE INFORMATION AND PROMOTIONS REGARDING OUR PRODUCTS. WE WILL ALSO VERIFY THAT YOU ARE OF LEGAL SMOKING AGE.

3. ENTER CODE INTO YOUR ACCOUNT:

Once you have registered for the Program online, you can enter a Code into your online Account by following the instructions on the Web Site. Enter the Code (either six or ten digits) exactly as it appears on the sticker. Captain Black Passport Stamp Points can be used toward redeeming merchandise such as lighters, sport vests and tents (see Rule 4 below for details for redeeming your Captain Black Passport Stamp Points). Points may not be redeemed for cash. When logged onto your Account you can check your Account History for point balances and details.

4. COLLECT TO GET GEAR:

A. REDEEM CAPTAIN BLACK PASSPORT STAMP POINTS ONLINE FOR MERCHANDISE: Collected points in your Account can be redeemed online for merchandise that is displayed on the Web Site (see Rule 4B below for information on redeeming points by mail). Each merchandise item has a required number of Captain Black Passport Stamp Points for redemption as stated on the Web Site. You cannot redeem a merchandise item unless you have accumulated the number of points required for that merchandise in your Captain Black Passport to Discovery Account. To redeem merchandise, browse the Web Site, select the merchandise item you wish to order, and click the “Add to Cart” button. Provide all information on the order “Confirmation” page. Once your order has been submitted, the required number of Captain Black Passport Stamp Points for that merchandise item(s) will be deducted from your Captain Black Passport to Discovery on-line account. Merchandise redeemed on line may not be redeemed by mail. Codes will be verified by database.

B. REDEEM CAPTAIN BLACK PASSPORT STAMP POINTS BY MAIL. If you do not wish to enter your codes online, you may also redeem your points for merchandise by mail as follows:

i. Use the Passport and Order Form sent to you in the mail. You may paste your stickers into your passport book where indicated. Once the correct number of points have been collected, fill out your official order form completely and mail to: Captain Black Passport to Discovery, PO Box 43364, Atlanta, GA 30336. You may request additional passport books with order forms by mailing request to: Captain Black Passport Books, PO Box 43364, Atlanta, GA 30336. Points redeemed by mail may not be redeemed on-line. Codes will be verified by database.

ii. Order Forms may also be printed from the Captain Black website. Mailed in order forms may not be redeemed on line. Follow instructions to complete the official Captain Black Passport to Discovery order form with your name, complete street address, daytime phone number and follow the directions on the order form to select merchandise. Merchandise can NOT be shipped to P.O. Box locations. You must verify that you are of legal smoking age.

iii. Starting on February 24, 2006 mail the completed Official Captain Black Passport to Discovery Order Form with the appropriate number of Stickers and Codes (each code = 10 points) from specially marked packages of Captain Black Little Cigars to Captain Black Passport to Discovery, PO Box 43364, Atlanta, GA 30336.

iv. Handwritten, photocopied, mechanically reproduced or typed Stickers/Codes/Points will not be accepted. All Stickers/Codes/Points or order form subject to verification. Actual Sticker(s) and order form must be submitted.

v. Sponsor not responsible for postage due, lost, late, misdirected, illegible, incomplete, damaged, torn or separated mail due to improper packaging of stickers or incomplete processing of mail or postage due mail or submissions.

vi. mailed in for merchandise will be verified.

C. SHIPMENT OF MERCHANDISE: SHIPMENT OF MERCHANDISE: In most cases, allow at least 10-12 weeks from receipt of order (some items may take up to 16 weeks) for shipment of merchandise, unless otherwise stated on the Web Site. Items ordered may at times ship separately. All gear will ship to the postal address that you specify on the order “Check Out” page. No P.O. boxes allowed. Items will only be delivered to addresses within the United States. No responsibility is assumed by Sponsor for any postal mail or deliveries returned as undeliverable without a forwarding address. No responsibility is assumed by Sponsor for an item after it has been shipped.

D. MERCHANDISE AVAILABILITY:

i. Disclaimer. Lane Limited will use reasonable efforts to maintain the availability of all items appearing on the Website. In some situations, certain items may not be available, either on a temporary or on a permanent basis. Lane Limited reserves the right to display a notice in the appropriate place on the website if items are not currently available for shipment.

ii. Merchandise. Lane Limited reserves the right to limit and not fulfill any order or orders containing more than five (5) items per name, address, or household. All merchandise is subject to availability and change. In the event an item requested is no longer available, Lane Limited, in its sole discretion, will substitute an item of equal or greater value. If the item you request is not available, but a similar item is available as determined by Lane Limited, Lane Limited will award the similar item (and if the Captain Black Passport to Discovery point value for the replacement is less than the requested item, Lane Limited will refund the difference in points). If the item(s) you request is/are not available and there is no similar item available, Lane Limited will refund your Captain Black Passport Stamp Points and shipping and handling fees (if applicable).

E. KEEP A COPY OF EMAIL NOTICE:

You will receive an e-mail notice confirming your order (online submissions only). The email notice will be forwarded to the email address you used when you registered for the Program. Print and keep all of the confirmation e-mails sent to you as these e-mails will contain important information about your order.

F. REDEEM CAPTAIN BLACK PASSPORT TO DISCOVERY POINTS BY DECEMBER 31, 2007

All Captain Black Passport Stamp Points must be redeemed by December 31, 2007. All Captain Black Passport Stamp Points in an Account will expire on December 31, 2007 at midnight EST, and all unused or unredeemed Captain Black Passport Stamp Points remaining in an Account after that date/time will be void and ineligible for redemption. A 30 day notice will be posted on the website notifying participants of the end of Captain Black Passport to Discovery Program. Continuation of program will be at the sole discretion of Lane Limited.

5. BONUS POINTS SIGN-UP OFFER:

Every consumer who registers on-line for the “Captain Black Passport to Discovery Program” will receive a one-time deposit of 100 bonus points to open their passport account. No purchase necessary.

6. CODES, POINTS AND ACCOUNTS:

A. CODE LIMITS: CODE LIMITS: Limit 10 points per each verified Code entered. Each Code can only be used once; subsequent attempts to re-submit or re-use the same Code will be void and ineligible for entry. Only the first Code submission received and recorded will be accepted.

B. ON LINE ACCOUNT LIMITS: Limit one (1) Account per person. Each person may only enter Codes into one Account; Codes entered by one person into multiple Accounts under different IDs may be voided by Sponsor in its sole discretion. No groups, clubs or organizations can register an Account or participate in the Promotion. Possession of a Code (or sticker with Code) does not constitute proof of entering Code into any particular on-line Account. Sponsor reserves the right to limit the number of Codes entered into an Account and/or the number of invalid entry attempts on a daily basis, or alter or modify any posted code entry limits, at any time and without prior notice.

C. POINT LIMITS: : Points in a particular Account cannot be transferred to or combined with or shared with any other Account.

D. NO TRANSFER: Codes, Points and Accounts cannot be sold, traded, bartered, assigned or transferred to or shared with a third party or auctioned through an online auction site or otherwise. Points, once redeemed for merchandise, cannot be refunded, transferred or re-used.

E. The “Account History” section of the Web site will record all transactions within your Account, including the last ten (10) Codes entered, and points used for redemption of merchandise. Sponsor assumes no liability for discrepancies, omissions, inconsistencies or errors in the number of Codes entered or the number of Captain Black Passport Stamp Points acquired as a result thereof as reported on the Web Site. The decisions of the Sponsor with respect to Code entry. Account balances and point transactions are final and binding in all respects.

7. VERIFICATION OF STICKER, CODE:

All Stickers and Codes are subject to verification at the sole discretion of Sponsor and its authorized agents. Consumers may be requested to send in their Stamps for verification. Anti-fraud detection devices may be used for verification purposes. Stickers and Codes thereon will be void if they fail to pass anti-fraud detection measures, or if determined by Sponsor and its agents in their sole discretion to be any of the following: duplicated, photocopied, reproduced, forged, defaced, tampered with, mutilated, cut, torn, erased or blank in whole or in part, illegible in whole or in part, smudged, disassembled or altered from the form in which it was issued, stolen, transferred, bartered, traded or auctioned (including, but not limited to an online Internet auction site), unissued, unauthorized, illegitimately obtained (i.e., through means other than retail purchase or free entry request), or if they fail to contain special markings, inks and/or security codes that may be applied by Sponsor at the time of production, or if they contain an unauthorized message, code or other marking not issued by Sponsor for use in this Program, or if defective, or if they contain printing or other mechanical errors or are printed or produced in error. No "points" will be credited for any Code deemed void for any reason, including without limitation, the following: Code is not verified or recognized as a valid Code issued by Sponsor in the Promotion; or Code is determined to be previously entered and used; or Code is incorrectly or incompletely entered or submitted. Sponsor shall have no obligation to the holder of any void sticker. Notwithstanding the foregoing, Sponsor may, at its sole discretion and without obligation, elect to replace an illegible sticker with another randomly selected sticker if appropriate upon request, while supplies last. Sponsor reserves the right to inspect and examine any illegible sticker prior to issuing a replacement. Replacements shall be issued at Sponsor's sole discretion and may be denied in the event of non-compliance with these Official Rules. Sponsor may change its policy or set limitations and restrictions on replacements at any time and without notice. Except as expressly stated above, Sponsor shall have no liability or obligation with respect to any void sticker. All Codes and Stickers and Official entry forms submitted by mail become the property of Sponsor and will not be returned or acknowledged. Only Codes from specially-marked Stickers on “Captain Black Little Cigars” packages are eligible for this Program and cannot be combined with codes from any other game or promotion.

8. ELIGIBILITY:

Program open only to legal United States residents residing within one of the fifty (50) United States or the District of Columbia throughout the Promotion Period. Void elsewhere including Puerto Rico and U.S. Virgin Islands and void where prohibited by law. Employees, officers, directors and agents of Lane Limited, and all of their respective parents, subsidiaries, divisions, affiliates, distributors, suppliers, or the advertising, promotional or judging agencies or other parties involved in any aspect with the creation, production, operation, execution and fulfillment of the Program (collectively, “Sponsor and its Administrators”) and the immediate family members of such individuals (parent, child, sibling or spouse of any of the foregoing, including step-parent, step-child or step-sibling) and household members of such individuals (whether related or not) are not eligible to participate. Groups, clubs or organizations are not permitted to register an Account or participate in this Program or distribute any portion of these Official Rules.

9. LIMITATIONS OF LIABILITY:

No responsibility or liability is assumed by the Sponsor and its Administrators for any technical problems or technical malfunction of any kind arising in connection with any of the following occurrences which may affect or interrupt the operation of the Web Site; hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or telephone providers; garbled, jumbled or faulty data transmissions; lost, late, delayed or intercepted e-mail or text messaging transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site that prevent entry of Points; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, human error, unauthorized tampering, hacking, fraud, theft, virus, bugs, worms; or destruction of any aspect of the Program or data thereof, including without limitation, loss, miscount, misdirection, inaccessibility or unavailability of an Account used in connection with the Program. Sponsor reserves the right to cancel or suspend one or more means of entry in the event of one of the foregoing occurrences. Sponsor and its Administrators are not responsible for any personal injury or property damage or losses of any kind which may be sustained to users or any other person's computer equipment resulting from participation in the Promotion, or use of or download of any information from the Web Site. Use of Web Site is at user's own risk. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any merchandise item. Recipient bears all risk of loss or damage to merchandise after delivery.

10. MODIFICATION:

In no event will Sponsor be obligated to award more merchandise than the number of items stated in these Official Rules. If for any reason Sponsor determines in its sole discretion that the promotion is no longer capable of running as intended by these rules for any reason whatsoever, Sponsor, at its sole discretion, reserves the right to cancel, terminate, suspend, postpone, delay or modify the Promotion in whole or in part, at any time if any aspect of the Promotion is not capable of running as planned or as intended by these Official Rules for any reason whatsoever, including but not limited to, any occurrences described in Rule 10 above, or any other causes which may corrupt or impair the integrity, security, fairness or proper conduct of the Promotion, as determined by Sponsor in its sole discretion.

11. CONDITIONS ON USER PARTICIPATION:

By participating, all participants signify their agreement to be bound by these Official Rules and the decisions of Sponsor and its Administrators, whose decisions in all aspects shall be final and binding, which govern activities on the Web Site. The Sponsor and its Administrators may, at their sole discretion, disqualify any individual from participating in any aspect of the Program, and/or may cancel, suspend or block any account registered by such person, if Sponsor and its Administrators deem or suspect that such person has engaged in or has attempted to engage in any of the following: (a) acting in violation of these Official Rules or the terms and conditions of the Web Site; or (b) damaging, tampering with or corrupting the operation of the Promotion; or (c) acting with intent to annoy, harass or abuse any other person; or (d) use of any automated bot, script or other robotic, mechanical, programmed or automated devices to submit data to the Web Site through online, text messaging or phone-in means; or (e) repeated attempts to enter void Codes in one or more Accounts, as determined by Sponsor; or (f) any unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (g) activity deemed in the sole discretion of Sponsor and its Administrators to be generally inconsistent with the intended operation of the Promotion. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR CORRUPT ANY WEB SITE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS ADMINISTRATORS RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW.

12. RELEASE OF LIABILITY:

By participating, all participants, on behalf of themselves, their executors, heirs and assigns, agree to release Sponsor and its Administrators from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property which may be sustained in connection with the conduct of the Promotion, or the receipt, ownership or use of merchandise item, or any inaccurate or incorrect data contained on the Web Site or in an Account. Under no circumstances will Sponsor and its Administrators be liable for punitive, incidental, consequential, or any other damages.

13. DISPUTES:

By participating, each participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Georgia or the appropriate New York State Court located in Westchester County, New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (iii) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the registrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
